Terms of service

These terms are the agreement between you and QuitPact. They say what the program is, what you pay, when the commitment amount can be charged, and what happens if something goes wrong. Please read them; the money rules matter.

1. Who we are and who can join

QuitPact ("we", "us") is an accountability service for adults who want to stop using nicotine. By buying a program you agree to these terms, the privacy policy and the refund policy.

You must be at least 18 years old and located in the United States. QuitPact is a service, not medical care. It does not diagnose, treat or cure anything, and it is not a substitute for advice from a doctor or a quit line. If you have a medical condition, are pregnant or take medication, talk to a doctor before and while quitting nicotine.

2. What you buy

A program is a fixed-term accountability service: 12 weeks for $99 or 30 days for $49, paid upfront. It includes randomly scheduled nicotine checks by text message, review of every check photo by a member of the QuitPact team, result messages, a failure notice and appeal process, and a program dashboard. It is not a subscription, has no recurring charge and is not sold in installments. The checks continue until the last day of the program.

You supply your own cotinine tests, saliva or urine, at your own cost; the onboarding shows the current options and prices. We accept any test that meets the standard in section 5. We do not sell, ship or guarantee the availability of any test.

3. The commitment amount

When you buy a program you choose a commitment amount: any whole-dollar amount from $50 to $1000 ($50, $100, $250, $500 are suggested). You are not charged this amount when you buy. Your card is saved, and the commitment amount is charged to it only if a failure is confirmed under section 6. If you complete the program without a confirmed failure, it is never charged.

The commitment amount is a charge you agree to under this agreement as part of the accountability service. It is not a bet, a wager, a prize pool, a deposit held for you or a donation. If it is charged, we keep it. We do not pay interest on it and we never hold your money before a confirmed failure.

By completing checkout you authorize us to charge the commitment amount to your saved card, without you being present, when and only when a failure is confirmed under these terms. You may update the saved card by contacting us. If a charge is declined, we may retry once after about three days and then send you a payment link; we do not add fees or interest and we do not use collection agencies.

The commitment amount is the same for a 30-day and a 12-week program and never increases during a program. There is one charge per program at most.

4. The nicotine-free condition

Your commitment is to be nicotine-free from your quit date (day 1) to the last day of the program. Nicotine-free means no nicotine from any source: no vape, cigarettes, cigars, pouches, chewing tobacco, snus, nicotine gum, patches, lozenges or sprays, no lower-strength products and no "just one". A cotinine test detects nicotine from all of these, so any of them can fail a check.

The checks measure cotinine, which the body produces from nicotine. A negative check means cotinine was below the test's cutoff; it is not proof that a person never vaped, and we never claim that. A positive check means nicotine exposure above the cutoff. Secondhand exposure produces cotinine far below the cutoff of the tests we accept.

5. Checks: how they work and what you must do

Checks start no earlier than day 8 and can come on any day until the last day of the program, at random. We never tell you the number of checks, their dates or how they are scheduled. Each check is sent by text message between 8 and 10 am in your time zone and is due by 12:00 noon the following day. If you have not submitted by the evening we send one reminder text, and if you have not submitted by the next morning we send one backup email.

To complete a check you open the link in the text, take a test as its instructions say, and photograph the result live on the check page. The page uses your phone's camera; photos from your camera roll are not accepted. The check link stops working at the deadline. Late submissions are not accepted under any circumstances; the only way to contest a missed check is an appeal (section 7).

You must keep enough tests on hand for the whole program. Any cotinine test with a saliva cutoff of 50 ng/mL or lower, or a urine cutoff of 200 ng/mL or lower, is accepted. If you use a brand other than the recommended one, you also photograph its box at your first check so we can accept the format. Not having a test at home is not a valid reason for missing a check.

A person reviews every photo. A check is marked passed (negative and readable), invalid (unreadable, wrong or expired test, not the current check, a format we cannot accept, or a technical problem) or positive. An invalid check never counts against you: you get a new check with a fresh 24-hour window. We may ask you to retake a check at any time if the evidence is unclear; that also never counts against you.

6. Failure, the notice window and what is charged

The following each create a failure notice: a check reviewed as a clear positive; a missed check, meaning a check where at least one of our messages (text, reminder or email) was delivered to you and nothing was submitted by the deadline; or your withdrawal from the program after your quit date (section 9). A check where none of our messages was delivered is never a failure; it is rescheduled.

A failure notice opens a 48-hour notice window. Nothing is charged during the window. If the window ends with no appeal, or your appeal is denied, or a retest after a granted appeal is positive, the failure is confirmed. When a failure is confirmed we charge the full commitment amount to your saved card and the program ends. One confirmed failure ends the program; there are no partial charges and no second charges.

We never charge a program that was completed, cancelled before the quit date, or passed its checks, and we never charge while an appeal is undecided. Every failure notice, appeal decision and charge is recorded in a log we keep.

7. Appeals

You can appeal a failure notice from the notice itself, with a reason, at any time before the window ends. Valid reasons are a medical emergency, or a result you dispute (including a claim of secondhand exposure). "Forgot", "busy", "phone was off", "travelling" and "no tests at home" are not valid reasons. We say this plainly so there are no surprises.

One appeal is granted per program. A granted appeal for a disputed positive gives you a retest with a 24-hour window: a negative retest voids the failure, a positive retest confirms it. A granted appeal for a missed check gives you a fresh check with a new 24-hour window; the old check is never reopened. A missed retest or missed fresh check confirms the failure. We may make an exception to the one-appeal rule for a documented emergency, at our discretion.

A person reads every appeal and decides before the window ends, normally within 24 hours. If the window would end while an appeal is undecided, it is extended until the decision. A failure caused by our own error (for example an undelivered message or a system fault visible in our logs) is voided without using your appeal.

8. Refunds and cancellation before your quit date

You can cancel your program at any time before your quit date, from your dashboard or by emailing us, for a full refund of the program fee. Your saved card is then never charged the commitment amount. Refunds go back to the card you paid with, usually within 5 to 10 business days.

From your quit date onwards the program fee is not refundable, because the service has started. There is no refund after a confirmed failure, because the service was delivered. The full policy is on the refunds page.

9. Withdrawing after your quit date

If you decide to stop after your quit date, that counts as a failure under this agreement: you receive a failure notice, the 48-hour window and the appeal rules apply, and if the failure stands the commitment amount is charged and the program ends. This rule exists because the program only works if quitting the program is not a free way out at the moment of a relapse. You can take a withdrawal back at any time within the notice window; nothing is then charged and the program continues.

If you stop texts (reply STOP), your checks continue by email with the same deadlines. If you also opt out of email, we have no way to send checks, and we treat that as a withdrawal.

10. Text messages and your consent

After payment we ask for a US mobile number and your express consent to text you. We text you only about your program: checks, reminders, results, notices and appeal decisions, a day-30 and a final milestone message, and sign-in codes if you ask for them. We do not send marketing texts and we do not share your number or your consent with anyone for marketing.

The consent wording you agree to is: "I agree to receive text messages from QuitPact about my nicotine checks and my pact at this number. Message frequency varies (about 2–4 texts a week during the program). Message and data rates may apply. Reply STOP to stop, HELP for help. See our privacy policy and terms."

Message frequency varies, about 2 to 4 texts a week during a program. Message and data rates may apply. Reply STOP at any time to stop texts (your checks then continue by email) and HELP for help. Carriers are not liable for delayed or undelivered messages. If you change your number, tell us; we will ask for your consent again at the new number.

11. Email and your accountability partner

We email you receipts, program messages, backup copies of checks and milestone content. You cannot opt out of program emails while your program is running, because they are part of the service; promotional emails, if any, carry an unsubscribe link.

If you name an accountability partner, we email them when you add them, when you complete the program, and, only if your commitment amount has been charged, that your program ended early. Partner emails never contain test photos, results or the amount involved. You see each message before it is sent and can remove your partner at any time.

12. Honesty, fair use and our right to end a program

The program relies on you taking real tests on yourself. Staging a result, using someone else's sample, editing a photo or otherwise cheating a check breaks this agreement. If we find clear evidence of cheating we may end your program without a refund; we will tell you why and you may reply. We do not charge the commitment amount for suspected cheating alone; it is charged only through the failure process in section 6.

We may end a program and refund the program fee in full (and release the commitment) if we cannot deliver the service, for example because we stop operating, because your number cannot receive texts and you do not provide an alternative, or because of a serious technical problem on our side. We will tell you by email.

13. What we are not responsible for

QuitPact is not a medical service, and nothing we send is medical advice. Home cotinine tests give preliminary results and can be wrong; that is exactly why a person reviews every photo, why unclear results never count and why you can appeal and retest. We are not responsible for the accuracy of any test, for a test's availability or price, for delays of the postal or courier services you order tests from, or for your mobile carrier's delivery of messages.

To the extent the law allows, our total liability to you for anything connected with QuitPact is limited to the program fee you paid, and we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under the laws of your state.

14. Disputes and governing law

If something goes wrong, write to hello@quitpact.com first; we answer every message personally and most problems can be fixed quickly. If we cannot agree, either of us may bring a claim in a small claims court or another court with jurisdiction. These terms are governed by the laws applicable where you live in the United States, to the extent they protect you, and otherwise by the laws of the Canadian province where QuitPact is based. QuitPact is based in Canada; you are buying in US dollars.

Nothing in these terms stops you from contacting a consumer protection agency, your card issuer or any regulator.

15. Changes to these terms

We may update these terms for future programs. The terms in force when you buy a program apply to that program for its whole length, unless a change is required by law or benefits you. We keep a dated version of the exact text you agreed to.

These terms were last updated on the version date shown at the top of this page.
